1.1 Welcome to shipbob (individually or collectively, "shipbob," "we," "us," or "our"). Shipbob takes its responsibilities under applicable privacy laws and regulations ("Privacy Laws") seriously and is committed to respecting the privacy of our shipbob website and mobile application (the "Platform") (we refer to the Platform and the services we provide on our Platform, collectively, the "Services"). Users are those who register for an account on our Website to use the Services, including buyers and sellers (individually or collectively, "User," "you," or "your"). We recognize the importance of the personal data you entrust to us and believe it is our responsibility to properly manage, protect, and process your personal data. This privacy policy ("Privacy Policy" or "Policy") is designed to help you understand how we collect, use, disclose, and/or process the personal data you provide to us and/or that we possess about you, whether now or in the future, and to help you make informed decisions before providing us with any of your personal data.

● When you use our electronic services, or interact with us through our applications or use services on our platform. This includes, but is not limited to, cookies we may deploy when you interact with our apps or websites;


● When you grant permission on your device to share information with our apps or platforms;


● When you link your Shipbob account with your social media or other external accounts or use other social media features, in accordance with the provider's policies;


● When you conduct transactions through our services;


● When you provide us with feedback or make a complaint;


● When you register for a competition; or


● When you submit your personal data to us for any reason.

3. What personal data does Shipbob collect?


3.1 The personal data shipbob may collect includes, but is not limited to:


● Name;


● Email address;


● Date of birth;


● Billing and/or shipping address;


● Bank account and payment information;


● Phone number;


● Gender;


● Information sent by or associated with the device used to access our services or platform;


● Information about your network and the people and accounts you interact with;


● Photographs or audio or video recordings;


● Government-issued identification or other information we require for due diligence, knowing your customer, identity verification, or fraud prevention purposes;


● Marketing and communications data, such as your preferences for receiving marketing from us and third parties, your communications preferences, and your communication history with us, our service providers, and other third parties;


● Usage and transaction data, including details about your searches, orders, ads and content you interact with on the platform, and other products and services relevant to you;


● Location data;


● Any other information about users when they register to use our services or platform and while they use our services or platform, as well as information related to how they use our services or platform; and


Aggregated data about user engagement with content.


3.2 You agree not to submit any inaccurate or misleading information to us, and you agree to notify us of any inaccuracies or changes to such information. We reserve the right, at our sole discretion, to request further documentation to verify the information you provide.


3.3 If you register as a user of our platform using your social media account ("Social Media Account"), link your shipbob account to your Social Media Account, or use any shipbob Social Media features, we may have access to the information you provide about you. This information is voluntarily provided to your social media account provider in accordance with the policies of that provider, and we will always manage and use any such personal data in accordance with this Policy.


3.4 If you do not wish us to collect the above information/personal data, you may opt out at any time by notifying our Data Protection Officer in writing. For more information on opting out, please see the section below titled "How can you withdraw consent, delete, request access to, or modify information you have provided to us?" However, please note that opting out or withdrawing your consent to our collection, use, or processing of your personal data may affect your use of the Services and Platform. For example, opting out of the collection of location information will disable location-based features.


4. Collection of Other Data


4.1 Like most websites and mobile applications, the information sent by your device may include data about you logged by web servers when you browse our Platform. This typically includes, but is not limited to, your device's Internet Protocol (IP) address, computer/mobile device operating system and browser type, mobile device type, mobile device characteristics, unique device identifier (UDID) or mobile device identifier (MEID) for your mobile device, the address of the referring website (if any), the pages you visited on our websites and mobile applications, and the time of your visit, and sometimes "cookies" (which can be disabled using your browser preferences) that help websites remember your last visit. If you are logged in, this information will be associated with your personal account. This information is also included in anonymous statistics to help us understand how visitors use our websites.


4.2 Our mobile applications may use technologies such as GPS and Wi-Fi to collect precise information about the location of your mobile device. We collect, use, disclose, and/or process this information for one or more purposes, including, but not limited to, providing you with the services you request or providing you with relevant content based on your location, or allowing you to share your location with other users as part of the services offered through our mobile applications. 4.3 When you view content and advertisements on our platform or through the Services, and access other software, much of the same information is sent to us (including, but not limited to, your IP address and operating system) as when you view pages on our websites or mobile applications. However, instead of page views, your device sends us information about the content, advertisements, and/or software you viewed and when you installed them on the Services and Platform.


5. Cookies


5.1 We or our authorized service providers and advertising partners may, from time to time, use "cookies" or other features that allow us or third parties to collect or share information related to your use of our services or platforms. These features help us improve our Platform and the services we offer, help us offer new services and features, and/or enable us and our advertising partners to provide you with more relevant content, including through remarketing. A "cookie" is an identifier stored on your computer or mobile device that records data about your computer or device, how and when you use or access the Services or Platform, how many people use it, and other activities within our Platform. We may link cookie information to personal data. Cookies are also linked to information about the items you choose to purchase and the web pages you view. 6.2 You acknowledge, consent, and agree that Shipbob may access, preserve, and disclose your account information and content if required to do so by law, pursuant to a court order, or any governmental or regulatory authority with jurisdiction over Shipbob, or in good faith, if Shipbob has a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (a) comply with legal process; (b) comply with any governmental or regulatory authority with jurisdiction over Shipbob; (c) enforce the Shipbob Terms of Service or this Privacy Policy; (d) respond to any threatened or actual claims against Shipbob or other claims that any Content infringes the rights of a third party; (e) respond to your customer service requests; or (f) protect the rights, property, or personal safety of Shipbob, its users, and/or the public.


6.3 Because the purposes for which we will/may collect, use, disclose, or process your personal data depend on the circumstances at hand, such purposes may not appear above. However, we will notify you of such additional purposes at the time we obtain your consent, unless privacy laws permit the processing of applicable data without your consent.


7. How does Shipbob protect and retain customer information?


7.1 We implement a variety of security measures to ensure the security of your personal data on our systems. User personal data is contained behind secure networks and is only accessible by a limited number of employees with special access rights to such systems. However, absolute security cannot be guaranteed.


7.2 We will retain personal data in accordance with the Privacy Act and/or other applicable laws. This means that we will destroy or anonymize your personal data when we reasonably determine that: (i) retention of such personal data no longer serves the purpose for which it was collected; (ii) retention is no longer necessary for any legal or business purpose; and (iii) there are no other legitimate interests requiring further retention of such personal data. If you cease using the Platform, or if your license to use the Platform and/or Services is terminated or revoked, we may continue to store, use, and/or disclose your personal data in accordance with this Privacy Policy and our obligations under the Privacy Act. We may dispose of your personal data securely and without further notice, in accordance with applicable law.


8. Does shipbob disclose information it collects from its visitors to external parties?


8.1 In conducting our business, we will/may need to use, process, disclose, and/or transfer your personal data to our third-party service providers, agents, and/or our affiliates or related companies and/or other third parties, who may be located in or outside of Singapore for one or more of the purposes listed above. These third-party service providers, agents, and/or affiliates or related companies and/or other third parties will process your personal data on our behalf or otherwise to fulfill one or more of the purposes listed above. We strive to ensure that third parties and our affiliates keep your personal data secure, protected from unauthorized access, collection, use, disclosure, processing, or similar risks, and retain your personal data only for as long as necessary for the purposes listed above. Such third parties include, but are not limited to:


● Our subsidiaries, affiliates, and related companies;


● Buyers or sellers with whom you transact or interact on the Platform or in connection with your use of the Services for the purposes listed above;


● Other users of our Platform for one or more of the purposes listed above;


● Contractors, agents, service providers, and other third parties we use to support our business. These include, but are not limited to, parties who provide administrative or other services to us, such as post offices, logistics service providers, financial service providers, advertising and marketing partners, telecommunications companies, information technology companies, and data centers;


● Governmental or regulatory authorities with jurisdiction over Shipbob, or such other authorities as permitted under Section 6.2;


● Personal data held by Shipbob about users of our Services is among the assets transferred in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Shipbob's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding; or the counterparty in any business asset transaction in which Shipbob or any of its affiliates or related companies participates; third parties to whom we disclose information for one or more purposes and who, in turn, collect and process your Personal Data for one or more purposes.


8.2 We may share user information, including statistical and demographic information about our users and information about their use of the Services, with advertising partners and third-party providers of advertising, remarketing, and/or other programs.


8.3 For the avoidance of doubt, if privacy laws or other applicable laws permit us and other organizations to collect, use, or disclose your personal data without your consent, such legal permissions shall continue to apply. Subject to the foregoing and in compliance with applicable laws, we may use your personal data for recognized legal reasons, including to comply with our legal obligations, to perform our contract with you, to pursue legitimate interests, and where our reasons for using this data outweigh any prejudice to your data protection rights, or, where necessary, in connection with legal claims.


8.4 Personal data transmitted to or contained on the Website may be unlawfully intercepted or accessed by third parties, technology may malfunction or not work as intended, or information may be accessed, misused, or misused through no fault of ours. Nevertheless, we will deploy reasonable security arrangements to protect your personal data as required by privacy laws; however, absolute security cannot be guaranteed, including, but not limited to, unauthorized disclosure resulting from malicious and sophisticated hacking attacks through no fault of ours.


8.5 shipbob allows you to share YouTube videos ("YouTube Content") within shipbob. To enable this, shipbob uses the YouTube API service provided by YouTube. By sharing YouTube content, you hereby agree to be bound by the Google Privacy Policy (http://www.google.com/policies/privacy).


8.6 Subject to the shipbob Terms of Service, users (including any employees, agents, representatives, or any other person acting on behalf of or for such user) who, through use of the Services, come into possession of another user's personal data (a "Receiving Party") hereby agree that they will (i) comply with all applicable privacy laws with respect to any such data, including any collection, processing, storage, or transmission of such data; (ii) permit shipbob or the user whose personal data the Receiving Party has collected (a "Disclosing Party") to delete such data from the Receiving Party's database; and (iii) in each case of (ii) and (iii) above, permit shipbob or the Disclosing Party to review the information the Receiving Party has collected about them, in accordance with and as required by applicable law.


8.7 Notwithstanding anything herein, the Seller (including any employee, agent, representative or any other person acting on behalf of or for such User) shall comply with all applicable privacy laws and, with respect to any Buyer's Personal Data received from shipbob, (i) shall not use such Buyer's Personal Data without the prior written consent of the Buyer and shipbob, except as reasonably necessary to respond to the Buyer's inquiries and to respond, process, handle or complete the transaction; (ii) shall refrain from using such information to contact the Buyer outside of the shipbob platform; (iii) shall not disclose such Buyer's Personal Data to any unauthorized third party without the prior written consent of the Buyer and shipbob; (iv) shall implement adequate security measures to protect the Personal Data of each shipbob User in its possession, retain such data only for as long as is necessary for the purposes set out above and in accordance with privacy laws, and delete or return such data to shipbob upon any request by shipbob or as soon as reasonably possible after completion of the transaction; and (v) shall notify shipbob's Personal Data Protection Officer at service@shipbob.shop of any potential data breach or other loss of User Data.


9. Information About Children


9.1 The Services are not intended for children under the age of 13. We do not knowingly collect or maintain any personal data or non-personally identifiable information from anyone under the age of 13, and no part of our Platform or other Services is directed to children under the age of 13. As a parent or legal guardian, please do not allow such children in your care to submit personal data to Shipbob. If the personal data of a child under the age of 13 in your care is disclosed to Shipbob, you hereby consent to the processing of that child's personal data and accept and agree to be bound by this Policy on that child's behalf. We will close any accounts used exclusively by such children and delete and/or remove any personal data that we believe has been submitted by a child under the age of 13 without parental consent.


10. Information Collected by Third Parties


10.1 Our Platform uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies (text files placed on your device) to help the Platform analyze how users use the Platform. The information generated by the cookie about your use of the Platform (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Platform, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required by law, or where third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.


10.2 We and third parties may, from time to time, make software applications available for download through the Platform or Services. These applications may separately access and allow third parties to view information that identifies you, such as your name, your user ID, your device's IP address, or other information, such as any cookies you have previously installed or that have been installed for you by third-party software applications or websites. In addition, these applications may require you to provide additional information directly to the third party. The third-party products or services offered through these applications are not owned or controlled by shipbob. We encourage you to read the terms and other policies of such third parties posted on their websites or elsewhere.


11. Disclaimer Regarding Security and Third-Party Websites


11.1 We do not guarantee the security of your personal data and/or other information you provide on third-party websites. We do implement various security measures to maintain the safety of your personal data in our possession or control. Your personal data is contained behind secure networks and is only accessible by a limited number of persons with special access rights to such systems, who are required to maintain confidentiality. When you place an order or access your personal data, we provide the use of a secure server. All personal data or sensitive information you provide is encrypted in our databases and can only be accessed as described above.


11.2 To provide you with enhanced value, we may select various third-party websites to link to and integrate with the Platform. We may also engage in co-branding and other relationships to offer e-commerce and other services and functionality to our visitors. These linked websites have separate and independent privacy policies and security arrangements. Even if the third party is affiliated with us, we have no control over these linked websites, each of which has separate privacy and data collection practices independent of ours. We may not receive any data collected by our co-branding partners or third-party websites (even if offered on or through our Platform).


11.3 Therefore, we are not responsible for the content, security arrangements (or lack thereof), and activities of these linked websites. Nonetheless, we strive to protect the integrity of our Platforms and the links on each Platform and therefore welcome any feedback regarding these linked sites (including, but not limited to, if a specific link does not work).


12. Does shipbob transfer your information overseas?


12.1 Your personal data and/or information may be transferred, stored, or processed outside of your country for one or more purposes. In most cases, your personal data will be processed in Singapore, where our servers are located. shipbob will only transfer your information overseas in accordance with the Privacy Act.


13. How can you withdraw your consent, request access to, or correct information you have provided to us?


13.1 Withdrawal of Consent


13.1.1 You may withdraw your consent to the collection, use, and/or disclosure of your personal data and/or request the deletion of your personal data in our possession or control by emailing our Personal Data Protection Officer at service@shipbob.shop. We will process such requests in accordance with this Privacy Policy and our obligations under the Privacy Act and other applicable laws. However, withdrawing your consent may mean that we will be unable to continue providing you with the Services, and we may need to terminate your existing relationship and/or contract with us.


13.1.2 If you share YouTube content, in addition to withdrawing your consent by emailing us in accordance with Section 14.1.1, you may also withdraw shipbob's access to your personal data through the Google security settings page at https://security.google.com/settings/security/permissions.


13.2 Requesting Access to or Correction of Personal Data


13.2.1 If you have an account with us, you may access and/or correct your personal data currently in our possession or control by yourself through your account settings page on the Platform. If you do not have an account with us, you may request access to and/or correction of your personal data currently in our possession or control by submitting a written request to us. We will need sufficient information from you to establish your identity and the nature of your request so that we can process your request. Therefore, please submit your request by emailing our Personal Data Protection Officer at service@shipbob.shop.


● To contact or communicate with you by voice call, text and/or fax message, email and/or postal mail, or other means, to manage and/or administer your relationship with us or your use of our services, such as, but not limited to, communicating administrative information related to our services. You acknowledge and agree that we may carry out such communications by posting letters, documents, or notices to you, which may involve the disclosure of certain personal data about you in order to deliver such data, as well as the data on the external cover. You may unsubscribe from receiving marketing communications at any time using the unsubscribe function in electronic marketing materials. We may use your contact information to send newsletters or marketing materials from us and our affiliates;


● To respond to legal process or comply with any applicable legal, governmental, or regulatory request in any relevant jurisdiction, or if we believe in good faith that such disclosure is necessary, including, but not limited to, disclosure required by any law binding on Shipbob or its related corporations or subsidiaries (including, where applicable, revealing your name, contact information, and company details);

Please note that we are not required to respond to or process your access request unless you agree to pay the fee.
